Terms of Use — Do or Drink!

Please read these Terms of Use ("Terms") carefully before using the "Do or Drink!" mobile application (the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

The App is provided by Oleksandr Ploskovytskyy, an individual sole proprietor based in Poland ("we", "us", or "our"), trading as "Game Time".

1. The App

Do or Drink! is a social party card game for adults. Players add participants, choose card decks, and take turns drawing challenge cards. The core rule is simple: if you don't want to do what a card says, you take a drink. "Drinking" can mean an alcoholic drink, water, or any other substitute the group agrees on — the App does not require anyone to consume alcohol.

2. Eligibility and Age Requirement

You must be at least the legal drinking age in your country, state, or jurisdiction of residence to use the App. In no event may anyone under 18 use the App. By using the App, you confirm that you meet this requirement.

The App contains content that references alcohol consumption, dares, social interactions, and physical challenges, and is intended for adults only.

3. Responsible Use, Assumption of Risk, and Safety

You use this App and play this game entirely at your own risk. By using the App, you acknowledge and agree that:

• Drinking is optional and never required to be alcoholic. You may always substitute water or any non-alcoholic option. Never drink alcohol if you are pregnant, driving, taking medication that interacts with alcohol, under the legal drinking age, or have any health condition affected by alcohol.
• Drink responsibly. Excessive alcohol consumption is dangerous and can cause serious injury or death. Know your limits and never pressure others.
• The cards are prompts, not commands. You can always say no, skip any card, and stop at any time. Physical contact and interactions with others are entirely optional and require consent from everyone involved.
• You are responsible for your own conduct and safety, including any dares, physical activities, interactions with strangers, or location-based challenges. Only do what is safe, legal, and comfortable for you and those around you.
• We are not responsible for any injury, illness, loss, damage, legal consequence, or other harm arising from your use of the App or participation in the game.

If a card ever feels unsafe or uncomfortable, do not do it — drink, skip, or stop.

4. Accounts

To use the App you sign in with Apple Sign-In. You are responsible for maintaining the confidentiality of your account and for all activity under it. You agree to provide accurate information and to comply with Apple's terms.

You may delete your account at any time via Settings → Delete Account. Deleting your account removes your account and associated personal data as described in our Privacy Policy.

5. In-App Purchases

• Some card decks are free; others are available as one-time paid purchases.
• All purchases are processed by Apple through the App Store and are subject to Apple's terms. Prices are shown in your local currency.
• Purchases unlock content tied to your account/Apple ID. You can restore previous purchases via Settings → Restore Purchases.
• All sales are final and non-refundable, except as required by applicable law or by Apple's refund policy. Refund requests are handled by Apple, not by us.

6. Intellectual Property

The App, including its card content, text, designs, graphics, and software, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the App or its content.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms;
• Use the App in a way that harms, harasses, or endangers yourself or others;
• Attempt to circumvent purchase mechanisms or access paid content without paying;
• Interfere with or disrupt the App or its servers.

8. User Content

The only content you enter is player names, which are stored locally on your device. You are responsible for that content and agree not to enter anything unlawful or infringing.

9. Availability and Changes

The App is currently available on iOS only via the Apple App Store. We may update, change, suspend, or discontinue the App or any feature (including specific decks) at any time, including through over-the-air updates. We do not guarantee uninterrupted or error-free operation.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, ILLNESS, OR LOSS ARISING FROM YOUR USE OF THE APP OR PARTICIPATION IN THE GAME. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM.

Nothing in these Terms excludes liability that cannot be excluded under applicable law (including liability for death or personal injury caused by gross negligence or intentional misconduct).

12. Apple-Required Terms

These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support. In the event of any failure of the App to conform to any warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is a third-party beneficiary of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

13. Governing Law

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. Disputes will be subject to the competent courts of Poland, unless mandatory consumer-protection laws in your country of residence provide otherwise.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date. Continued use of the App after changes means you accept the updated Terms.
